1.1 - WHAT DO WE DO WITH YOUR INFORMATION?
When you purchase something from Packlane, as part of the buying and selling process, we collect the personal and business information you give us such as your name, address and email address.
When you browse our website, we also automatically receive your computer’s internet protocol (IP) address and other basic information about your browser and operating system, to assist us in providing support and improving customers’ experiences with our products.
If you are providing any personal information from outside of the United States, you authorize Packlane to transfer your personal information to the United States and retain your personal information in the United States.
With your permission, we may send you emails about our products, services and other updates.
1.2 - CONSENT
How do you get my consent?
When you provide us with personal or business information to obtain a quote; complete a transaction; verify or charge your credit/debit card, ACH, Wire Transfer, or the like; place an order; redeem an offer; or arrange for a delivery, you are consenting to our collecting, storing, and using that information for your benefit and/or to improve our services and offerings. You are also consenting to our disclosing that you are a Packlane customer and, in that regard, are consenting to our using the name of your business and/or logo.
If we ask for your personal or business information for any other reasons, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.
How do I withdraw my consent?
If you change your mind, you may withdraw your consent for Packlane’s continued collection, use or disclosure of your information, at any time, by contacting us. Packlane reserves the right to retain any information previously collected for the purposes of completing any orders or resolving any disputes, as well as for aggregated data analytics.
1.3 - DISCLOSURE
We may disclose your personal or business information if we are required by law to do so.
1.4 - PAYMENT
Your payment is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS).
Our direct payment gateway provider adheres to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit/debit card information by our store and its service providers.
1.5 - THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal and business information will be handled by these providers.
In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States laws and regulations, including but not limited to the Patriot Act.

1.6 - SECURITY
To protect your personal and business information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
Credit/debit card information and banking information for ACH payments that you input as part of your checkout process is transmitted directly to our secure merchant processor using their best practices and security. Packlane does not keep or have access to full credit/debit card numbers or bank account identification for ACH processing during online checkout or at any other time.
If Packlane is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products and services to you.

2.2 - SERVICE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products or services for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws, rules or regulations in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your service.
2.3 - GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including payment information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit/debit card information and bank account information for ACH processing is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell, lease, license or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
2.4 - ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Prices for our products and services are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service or any products (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service or any products.
2.6 - PRODUCTS AND SERVICES
All products are made to order based on your custom specifications, and therefore cannot be cancelled once you approve your proof or the order’s proof-bypass window has passed. You, the customer, are responsible for ensuring that your order correctly specifies size, color, artwork, quantity, style of product, and type of product. Packlane is not responsible for errors made by the customer during the ordering process.
We have made every effort to display as accurately as possible on the website the colors, images, and artwork you upload onto a product design. We also have made every effort to ensure that the proportions and style of all customizable products appear as accurately as possible. We cannot guarantee that your computer monitor's display of any color, artwork, sizing, or feature will be accurate.
We reserve the right to refuse any order you place with us. We reserve the right, but are not obligated, to limit the sales of our products or Service to any geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or services, or product or service pricing, are subject to change at any time without notice, at our sole discretion. We reserve the right to modify or discontinue any product or service at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations or other requirements, or that any errors in the Service will be corrected in a timely manner or at all.
2.7 - INTERNATIONAL ORDERS AND SHIPMENTS
We welcome orders from our non-US customers. All transactions will be completed in US dollars, using the commercial exchange rate calculated by our merchant processor at the time the transaction is completed. No adjustments will be made to account for fluctuations in the exchange rate between an original transaction and any subsequent refund transaction.
If your shipping destination is outside of the US, you may be required to pay taxes (including but necessarily limited to sales, value-added, use and excise taxes), tariffs, import fees, duties and/or other fees, charges or assessments related to your order. We recommend consulting a Customs Broker to assist with this topic. Packlane does not collect any taxes, fees, duties or other charges or assessments for non-US shipments, and you will be responsible for paying them at the time of your order's receipt.
2.8 - RETURN POLICY, REFUNDS, AND DISPUTES
Since all orders are made to custom specifications, we don't allow cancellation after proof acceptance or after the proof-bypass window is passed, nor do we allow returns on completed orders. However, if you're unhappy with your order and feel like we didn't do a great job, please contact us and we'll do our best to rectify the situation. Should we, in our sole discretion, decide to replace any products or to refund or credit to you any amounts paid for an order, that replacement, refund, or credit shall constitute our entire, sole and exclusive liability, and your sole and exclusive remedy, with respect to that order.
If Packlane agrees to refund any amounts to Customer, then Customer understands and agrees that such refund shall shall be refunded to Customer by means of how the original payment by Customer was made (e.g., credit card). In the case of orders placed by Customer using an Apruve line of credit, any refunds will first be paid by Packlane to Apruve and then, with respect to any remainder that is due and owing to Customer, such remaining amount shall be refunded to Customer by means of how the original payment made by Customer was made (e.g., credit card).
If you dispute any charge that is made to your credit/debit card, you agree that Packlane may authorize a third party vendor to handle and seek to resolve such dispute on Packlane’s behalf, which may include Packlane providing such vendor with the following information: your name, physical address, email address, phone number and the first 6 and last 4 digits of your credit/debit card number. You agree that Packlane may provide such information to the third party vendor and that the third party vendor may further disclose that information to your credit/debit card company, the bank issuing the credit/debit card and Packlane’s merchant processing company for the purpose of resolving the dispute. Packlane will endeavor to have the third party vendor agree to maintain the confidentiality of such information.
If you dispute valid charges made by Packlane to your credit/debit card and your dispute is subsequently found to be fraudulent, you agree to reimburse Packlane for Packlane’s expenses (including bank’s and attorney’s fees) incurred in connection with resolving the dispute.
2.9 - ACCURACY OF BILLING AND ACCOUNT INFORMATION / FINANCIAL RESPONSIBILITY
We may, in our sole discretion, limit or cancel quantities purchased per account, per household or per order. These restrictions may include orders placed by or under the same customer account, the same payment method (credit/debit card, ACH, Wire Transfer, or other), and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.
You agree to provide current, complete and accurate purchase and account information for all purchases made on our website. You agree to promptly update your account and other information, including your email address and credit/debit card numbers and expiration dates or banking information for ACH/wire transfer payments, so that we can complete your transactions and contact you as needed.
For orders funded with an Apruve line of credit, if for whatever reason, the relationship between Customer and Apruve terminates before shipment of an order is made, or if Customer cancels an order after Packlane's stated cancellation window and before the order is shipped, then Customer agrees that they shall be solely and fully responsible and liable for payment of such order, which payment shall be made directly to Packlane. Customer further agrees that such payment shall be due and owing to Packlane immediately upon receipt of an invoice from Packlane.

2.10 - OPTIONAL TOOLS
We may provide you with access to third-party tools which we neither monitor nor over which we have any control or input.
You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

If, at our request, you send certain specific submissions (for example contest entries) or, without a request from us, you send us creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, display, publish, distribute, translate and otherwise use and exploit in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation or other consideration for any comments; or (3) to respond to any comments.

You agree that your comments will not violate any right of any third-party, including without limitation, patent, copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. The rights, obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of our relationship or any transactions completed on our website for all purposes.
